What Should You Know About Chapter 13 Bankruptcy?
As with any bankruptcy filing in Virginia, the court will put an automatic stay in place, immediately prohibiting creditors from continuous collection activities on your preexisting debt. This temporary injunction halts foreclosure proceedings, wage garnishment and other activity during bankruptcy. More importantly, it gives you the relief you need to stop the debt cycle.
Are you in financial distress because of overwhelming mortgage payments? Bankruptcy does not prevent you from working with your lender toward modification.
The repayment plan is the center of Chapter 13 bankruptcy. Under the plan, you make a single monthly payment for a period lasting three to five years. Bankruptcy court must approve the proposed plan based on several factors, which is why it is so important to disclose all aspects of your financial situation to your lawyer.
When you successfully complete the repayment plan, most or all of your remaining unsecured debt is discharged.
